GENERAL TERMS AND CONDITIONS OF SALE – INSOMNI'HACK TICKETING
These General Terms and Conditions of Sale (the "Terms") govern the online sale of tickets granting access to the Insomni'hack event (the "Event") organized by Insomni'hack Association, c/o Orange Cyberdefense SA, an association with its registered office at Rue du Sablon 4, 1110 Morges, Switzerland, registered under company number CHE-431.497.644 (the "Organizer").
Any ticket order placed on the official website insomnihack.ch (the "Website") implies full and unconditional acceptance of these Terms by the purchaser (the "Customer").
These Terms set out the conditions governing the online sale of tickets granting access to the Event, as well as the respective rights and obligations of the Organizer and the Customer. They apply to the exclusion of any other terms and conditions, in particular those applicable to other sales channels.
Tickets are sold exclusively online via the official Website. No tickets are sold on-site on the day of the Event (unless there are still places available, in which case this will be announced by the Organizer), nor through unauthorized resellers or third-party platforms, unless expressly stated otherwise by the Organizer.
The Organizer recommends that Customers purchase their tickets in advance, as availability is limited. Ticket availability is subject to the remaining stock at the time the order is placed.
Article 3 – Early Bird tickets
A category of tickets known as "Early Bird" tickets may be offered at a reduced price, in limited quantities, from 3rd August to 30th September inclusive, or until sold out if this occurs earlier.
After 30th September, or once the allocation has sold out, Early Bird tickets will no longer be available unless the Organizer expressly decides otherwise.
Article 4 – Price and payment terms
Ticket prices are shown in Swiss francs (CHF), inclusive of applicable taxes, at the time of the order on the Website.
Payment is made online using the payment methods offered on the Website at the time of purchase, including where available:
- Bank card (Visa, Mastercard, American Express, Discover, Diners Club, and China UnionPay)
- Apple Pay
- Google Pay
- Link
- TWINT
Payment is due in full at the time of the order. The order becomes final only once payment has been successfully confirmed and the Customer receives the order confirmation.
Article 5 – Order confirmation, invoicing, and proof of purchase
A confirmation email, including proof of purchase, is sent automatically to the Customer once payment has been validated.
A personalized invoice may be issued exclusively for business customers. Any request for a personalized invoice must be sent after purchase, together with the company details and order number, to accounting@insomnihack.ch.
No personalized invoice is issued to private individuals. The proof of purchase sent by email at the time of the order shall serve as the relevant document, unless mandatory law provides otherwise.
Article 6 – Refunds and absence of a general withdrawal right
No refund request may be accepted if it is submitted within 48 hours before the scheduled start of the Event, except in cases where mandatory law requires otherwise or where the Organizer accepts the request as an exceptional commercial gesture. Lunch tickets remain strictly non-refundable under Article 6.4.
6.2 Refund requests submitted before the 48-hour deadline
Refund requests submitted more than 48 hours before the scheduled start of the Event must be sent to the Organizer in accordance with the procedure described in Article 10. The Organizer reserves the right to request supporting documents where the request is based on exceptional circumstances.
The Organizer may, at its discretion, waive the 48-hour non-refund rule in duly justified cases, including:
- Documented medical emergencies or serious health issues supported by appropriate medical evidence.
- Force majeure or extraordinary circumstances beyond the reasonable control of the Customer and the Organizer, including natural disasters, government-imposed restrictions, or cancellation of the Event.
Any waiver or refund granted under this Article 6.3 shall strictly and exclusively apply to the Event entry ticket, to the express exclusion of the lunch ticket.
6.5 Refund method
Any approved refund shall be made exclusively to the original payment method used for the purchase. The Organizer is not required to issue a refund to any alternative payment method, account, or beneficiary.
Approved refunds shall be processed within 15 business days from the date of approval. The Customer will receive a confirmation email regarding the processing status.
Article 7 – Personal nature of tickets
Access badges are personal and may not be shared with, transferred to, resold, or used by anyone other than the person designated at the time of purchase, unless the Organizer expressly authorizes a transfer or name-change procedure.
A Customer who is unable to attend the Event and wishes another person to attend in their place must comply with the refund conditions applicable at the time of the request. No transfer procedure is offered, thus the third party must purchase a new access badge in their own name.
Article 8 – Access badge format and delivery
The Customer’s access credential (access badge) serves as the Customer's entrance ticket for the date or dates selected during registration. Where applicable, the badge also serves as the Customer's identification during the Event.
The access badge is delivered electronically to the email address provided by the Customer during registration. The Customer may present the access badge either in digital format on a mobile device or smartphone, or in printed form, provided that the QR code is clearly visible and scannable.
If the Customer does not receive the order confirmation email within a reasonable time after completing the registration, the Customer should check the spam and junk folders, verify the email address used during registration, and contact ticketing@insomnihack.ch. When contacting support, the Customer should provide the order number, registration email address, and full name.
The Organizer reserves the right to send the personalized access badge within one week before the Event date(s). This communication will be done exclusively by e-mail.
If the access badge contains any errors, the Customer must contact support as soon as possible. The Organizer may issue a corrected or replacement access badge.
Article 9 – Access to the Event
To facilitate entry, the Organizer strongly advise that Customers print their badge in advance or ensure that their digital badge is accessible on a sufficiently charged mobile device.
On each day of the Event, the Customer's badge may be scanned at the welcome desk in exchange for a wristband granting access to and from the venue for that day. No entry is permitted without a valid wristband, and wristbands may not be exchanged between participants. Re-entry is permitted during the day, subject to the venue's security rules and the Organizer's access-control procedures.
For any question relating to an order, refund request and/or access badge, the Customer may contact the support team at ticketing@insomnihack.ch. The Organizer aims to respond within 48 hours, although response times may vary during periods of high demand.
For business invoicing requests, Customers may contact accounting@insomnihack.ch.
The Organizer shall not be liable for non-performance or improper performance caused by force majeure, official measures, security incidents, technical failures, acts of third parties, or any other circumstance beyond its reasonable control.
To the extent permitted by applicable law, the Organizer excludes liability for indirect or consequential loss. Nothing in these Terms excludes or limits liability where such exclusion is not permitted under mandatory law, including in cases of unlawful intent or gross negligence where applicable under Swiss law.
Personal data collected during the ordering process is processed by the Organizer for the purposes of managing ticket sales, event access, customer support, invoicing, and the customer relationship, in accordance with the Organizer's privacy policy available on the Website.
Article 13 – Governing law and jurisdiction
These Terms are governed by Swiss law, subject to any mandatory consumer-protection provisions that may apply.
Article 14 – Amendments to the Terms
The Organizer reserves the right to amend these Terms at any time. The version applicable to the Customer is the one in force on the date of the order.
